Welcome to NC Discount Furniture.

These Terms of Service ("Terms") govern your access to and use of NCDiscountFurniture.com, any related webpages, customer accounts, online services, and purchases made from NC Discount Furniture ("NC Discount Furniture," "NCDF," "we," "us," or "our").

Please read these Terms carefully before using our website or purchasing merchandise.

By accessing our website, creating an account, requesting a quote, placing an order, or purchasing merchandise from NC Discount Furniture, you agree to these Terms and the policies incorporated into them.

If you do not agree to these Terms, please do not use the website or place an order.

1. ELIGIBILITY

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order through NC Discount Furniture.

By placing an order, you represent that:

  • You are legally authorized to make the purchase;

  • Information you provide is accurate and complete;

  • You are authorized to use the payment method submitted; and

  • You agree to comply with these Terms and applicable NC Discount Furniture policies.

2. POLICIES INCORPORATED INTO THESE TERMS

The following NC Discount Furniture policies are incorporated into and form part of these Terms when applicable to your order:

  • Price Match Guarantee

  • Any promotional terms applicable to a particular offer

Customers should review these policies before placing an order.

If a product or service is subject to additional written terms, those additional terms also form part of the agreement applicable to that transaction.

If there is a conflict between a general provision of these Terms and a more specific product, delivery, warranty, or transaction policy, the more specific provision will generally control with respect to that subject, except where applicable law requires otherwise.

3. OUR BUSINESS MODEL

NC Discount Furniture is an ecommerce furniture retailer.

We work with:

  • Furniture manufacturers

  • Authorized distributors

  • Warehouses

  • Fulfillment partners

  • Freight carriers

  • Final-mile delivery companies

  • White-Glove delivery providers

  • Other service providers

Many products are shipped directly from a manufacturer, distributor, warehouse, or fulfillment partner to the customer.

Merchandise does not necessarily pass through an NC Discount Furniture facility before delivery.

NC Discount Furniture remains the customer's retailer and point of contact for orders placed directly with NC Discount Furniture.

4. PRODUCT INFORMATION

We make reasonable efforts to provide accurate product information.

Product information may include:

  • Product descriptions

  • Dimensions

  • Materials

  • Construction details

  • Finishes

  • Colors

  • Fabric information

  • Leather information

  • Manufacturer specifications

  • Images

  • Availability

  • Estimated lead times

  • Warranty information

  • Assembly information

  • Delivery information

Much of this information is supplied by manufacturers or distributors.

Although we make reasonable efforts to maintain accurate information, manufacturer specifications may change and occasional errors may occur.

Please contact NC Discount Furniture before ordering if a particular specification is critical to your purchasing decision.

5. PRODUCT DIMENSIONS

Furniture dimensions may be approximate and may be rounded by manufacturers.

Customers should allow reasonable tolerances when planning furniture placement and delivery access.

Customers are responsible for determining whether merchandise will fit:

  • In the intended room

  • Through exterior doors

  • Through interior doors

  • Through hallways

  • Around corners

  • Through stairways

  • Inside elevators

  • Through building entrances

  • Through gates

  • Along the complete delivery path

Please do not rely exclusively on photographs to determine product scale.

6. COLOR, FINISH & MATERIAL VARIATION

Furniture and home furnishings may contain natural, handcrafted, or manufacturer-permitted variations.

These may include variations in:

  • Wood grain

  • Wood coloration

  • Knots

  • Mineral streaks

  • Stone veining

  • Marble patterns

  • Leather grain

  • Leather markings

  • Fabric texture

  • Pattern placement

  • Dye lots

  • Distressing

  • Antiquing

  • Glazing

  • Hand-applied finishes

  • Metal patina

  • Natural materials

Product colors may also appear differently because of:

  • Photography

  • Lighting

  • Computer displays

  • Mobile-device screens

  • Screen brightness

  • Display settings

Reasonable natural or manufacturer-permitted variations do not necessarily constitute a defect.

Customers for whom an exact color or finish match is important are encouraged to request available samples before ordering.

7. PRODUCT PHOTOGRAPHS

Product photographs are provided for illustrative and informational purposes.

Accessories, décor, mattresses, bedding, lighting, rugs, artwork, or other merchandise appearing in lifestyle photographs may not be included unless expressly identified as included.

Customers should review the written product description to determine exactly what is being purchased.

8. PRODUCT AVAILABILITY

Furniture availability can change quickly.

Availability may be based on information received from:

  • Manufacturers

  • Distributors

  • Warehouses

  • Electronic inventory feeds

  • Vendor portals

  • Manual inventory reports

Not every vendor provides real-time inventory information.

An item displayed as available may become unavailable before an order is processed or accepted by the applicable vendor.

NC Discount Furniture cannot guarantee that every product displayed online will remain available.

If merchandise cannot be fulfilled, NC Discount Furniture may cancel the affected item and refund the amount paid for merchandise that will not be supplied.

9. PLACING AN ORDER

When you submit an order, you are requesting to purchase the merchandise identified in that order subject to these Terms.

After checkout, you may receive an automated confirmation acknowledging that your order has been received.

An automated order confirmation does not necessarily mean that manufacturer availability, vendor acceptance, production capacity, or fulfillment has been confirmed.

NC Discount Furniture may review an order before completing fulfillment.

10. ORDER ACCEPTANCE

NC Discount Furniture reserves the right, where permitted by law, to accept, decline, hold, or cancel an order for legitimate reasons including:

  • Product unavailability

  • Manufacturer discontinuation

  • Vendor inability to fulfill

  • Pricing errors

  • Product-information errors

  • Payment failure

  • Suspected fraud

  • Security concerns

  • Manufacturer restrictions

  • Shipping restrictions

  • Delivery limitations

  • Quantity restrictions

  • Violations of these Terms

If NC Discount Furniture cancels paid merchandise that will not be fulfilled, the amount properly due for that merchandise will be refunded.

11. ORDER REVIEW

Customers are responsible for reviewing their order carefully before purchase and reviewing their order confirmation after purchase.

Please verify:

  • Product

  • Manufacturer

  • SKU

  • Quantity

  • Size

  • Configuration

  • Fabric

  • Leather

  • Color

  • Finish

  • Orientation

  • Shipping address

  • Billing information

  • Contact information

Notify NC Discount Furniture immediately if you believe an order contains an error.

Changes may not be possible after the order becomes committed to the applicable manufacturer or fulfillment partner.

12. PRICING

Prices are displayed in U.S. dollars unless otherwise stated.

Prices may change without notice before an order is placed.

A later price change does not automatically change the price of a previously completed transaction.

Certain products may be subject to manufacturer pricing programs including:

  • Minimum Advertised Price

  • Internet Minimum Advertised Price

  • Promotional pricing restrictions

  • Authorized-dealer requirements

NC Discount Furniture intends to comply with applicable manufacturer pricing agreements.

13. PRICING ERRORS

Although we make reasonable efforts to maintain accurate pricing, errors can occur.

Examples include:

  • Typographical errors

  • Incorrect manufacturer feeds

  • Incorrect configuration pricing

  • Incorrect discounts

  • Website errors

  • Data synchronization errors

  • Obvious pricing mistakes

Where permitted by law, NC Discount Furniture may decline or cancel an order affected by a material pricing error.

If payment has already been collected for merchandise that is cancelled and will not be fulfilled, the applicable amount will be refunded.

We may instead offer the customer an opportunity to purchase the merchandise at the corrected price.

14. PRICE MATCH GUARANTEE

Eligible price-match requests are governed by the separate NC Discount Furniture Price Match Guarantee.

A competitor price does not automatically qualify for a match.

Eligibility may depend on factors including:

  • Identical manufacturer SKU

  • Configuration

  • Fabric or finish

  • Authorized-dealer status

  • Product condition

  • Availability

  • Delivery cost

  • Delivery service level

  • Manufacturer pricing restrictions

A price match is not approved until confirmed by NC Discount Furniture.

15. SALES TAX

Applicable sales tax will be collected when required.

Tax amounts may be calculated based on factors including:

  • Delivery location

  • Product type

  • Applicable state and local laws

Tax-exempt customers must provide acceptable exemption documentation before the applicable transaction is processed as tax exempt.

Customers are responsible for providing accurate tax-exemption information.

16. PAYMENT

NC Discount Furniture may accept payment through methods displayed at checkout.

By submitting payment information, you represent that:

  • You are authorized to use the payment method;

  • The information provided is accurate;

  • You authorize the applicable charges associated with the order.

Orders may be delayed, held, or cancelled if payment cannot be authorized or verified.

17. PAYMENT AUTHORIZATION & FRAUD REVIEW

Orders may be subject to payment verification and fraud screening.

NC Discount Furniture may request additional information when reasonably necessary to verify:

  • Customer identity

  • Billing information

  • Shipping information

  • Payment authorization

We may decline or cancel transactions presenting legitimate fraud or security concerns.

18. FINANCING

Financing options offered through the website may be provided by independent third-party financial institutions.

Financing approval, interest rates, payment schedules, credit decisions, fees, disclosures, and financing terms are determined by the applicable finance provider.

NC Discount Furniture does not guarantee financing approval.

The customer's financing agreement with a third-party lender is separate from these Terms except as applicable to the underlying furniture purchase.

19. CANCELLATIONS & ORDER CHANGES

Furniture orders may become financially or contractually committed to a manufacturer, distributor, warehouse, or fulfillment partner before the merchandise physically ships.

Cancellation eligibility is therefore determined by the actual status of the order, not solely by whether a tracking number has been generated.

Cancellation and modification requests are governed by the NC Discount Furniture Cancellation & Order Change Policy.

Generally:

  • An order may be cancellable while NC Discount Furniture can cancel the applicable vendor commitment without cost or obligation;

  • Once a vendor commitment becomes non-cancellable, the customer order may also become non-cancellable;

  • Vendor-approved cancellations may be subject to actual applicable fees and costs;

  • Custom and special-order merchandise may become final once committed to production or the manufacturer;

  • Shipped merchandise generally cannot be cancelled as an ordinary cancellation.

A cancellation request is not approved until NC Discount Furniture confirms the cancellation in writing.

20. RETURNS & REFUNDS

Furniture purchases are generally final sale, subject to the exceptions contained in our Return & Refund Policy and applicable law.

NC Discount Furniture does not provide an unrestricted trial period for furniture.

Returns are not automatically available because of:

  • Buyer's remorse

  • Change in décor

  • Size preference

  • Comfort preference

  • Color preference

  • Customer measurement errors

  • Furniture that does not fit the intended space

  • Furniture that does not fit through the available delivery path

Any discretionary return must receive written authorization before merchandise is sent anywhere.

Unauthorized returns may be refused.

All return eligibility, fees, freight obligations, inspection requirements, and refund procedures are governed by the NC Discount Furniture Return & Refund Policy.

21. SPECIAL-ORDER & CUSTOM MERCHANDISE

Special-order, custom, made-to-order, modified, personalized, or customer-configured merchandise may include:

  • Custom upholstery

  • Customer-selected fabrics

  • Customer-selected leathers

  • Special finishes

  • Custom configurations

  • Special sizes

  • Furniture manufactured specifically for the customer

These orders may become non-cancellable and non-returnable once committed to the applicable manufacturer.

Customers are responsible for reviewing all selections carefully before placing a special or custom order.

22. SHIPPING & DELIVERY

Shipping and delivery are governed by the NC Discount Furniture Shipping & Delivery Policy.

Depending on the merchandise, delivery may occur through:

  • Small-parcel carrier

  • Freight carrier

  • LTL carrier

  • Threshold delivery

  • Room-of-Choice delivery

  • White-Glove delivery

  • Manufacturer delivery

  • Other approved delivery provider

Different products within the same order may ship separately.

23. SHIPPING ESTIMATES

Estimated processing, shipment, production, transit, or delivery dates are estimates unless expressly stated as guaranteed.

Furniture fulfillment may be affected by:

  • Manufacturer production

  • Inventory availability

  • Material availability

  • Warehouse transfers

  • Freight transportation

  • Carrier schedules

  • Weather

  • Supply-chain disruptions

  • Other circumstances

NC Discount Furniture will comply with applicable laws governing shipment representations, delay notices, cancellation options, and refunds.

Nothing in these Terms eliminates a shipment-delay cancellation or refund right that applicable law requires.

24. WHITE-GLOVE DELIVERY

When White-Glove Delivery is included or purchased, the service is governed by the NC Discount Furniture White-Glove Delivery Terms.

Depending on the service applicable to the order, White-Glove Delivery may include:

  • Scheduled delivery

  • In-home placement

  • Room-of-choice placement

  • Unpacking

  • Basic assembly

  • Removal of ordinary packaging materials

The exact service level varies by product, delivery provider, and location.

Customers should not assume that wall mounting, electrical work, furniture removal, unlimited stairs, structural modifications, or other specialized services are included unless specifically stated in writing.

25. CUSTOMER DELIVERY RESPONSIBILITIES

Customers are responsible for:

  • Providing an accurate delivery address;

  • Providing working contact information;

  • Responding to delivery scheduling;

  • Measuring the merchandise;

  • Measuring the delivery path;

  • Ensuring safe access;

  • Satisfying building requirements;

  • Reserving elevators where necessary;

  • Clearing the delivery path;

  • Having an authorized adult present when required.

Additional storage, redelivery, freight, or handling charges may apply when a delivery fails because of circumstances within the customer's reasonable control.

26. REFUSED DELIVERIES

Refusing delivery does not automatically cancel an order or create a return or refund right.

Customers should follow NC Discount Furniture's instructions concerning damaged merchandise.

Unauthorized refusal of otherwise conforming merchandise may result in applicable:

  • Outbound freight

  • Return freight

  • Storage

  • Handling

  • Warehouse

  • Redelivery charges

where permitted by law.

27. DAMAGED OR DEFECTIVE MERCHANDISE

Shipping damage, concealed damage, missing components, incorrect merchandise, and manufacturing defects are governed by the NC Discount Furniture Damaged & Defective Merchandise Policy.

Damaged or defective merchandise is handled through a claim process rather than as an ordinary preference return.

Customers may be asked to:

  • Provide photographs

  • Provide video

  • Retain packaging

  • Provide serial numbers

  • Provide delivery paperwork

  • Permit inspection

  • Permit professional repair

  • Accept replacement parts

  • Make merchandise available for authorized pickup

When appropriate and legally permitted, NC Discount Furniture, the manufacturer, carrier, or service provider should be given a reasonable opportunity to remedy a verified issue.

An available remedy may include:

  • Repair

  • Replacement parts

  • Replacement components

  • Manufacturer service

  • Replacement merchandise

  • Another appropriate resolution

A refund is not automatically required solely because the customer prefers a refund over a reasonable available remedy, except where applicable law provides otherwise.

28. MANUFACTURER WARRANTIES

Some merchandise includes a manufacturer's written warranty.

Warranty coverage varies by manufacturer and product.

Manufacturer warranty issues are governed by:

  • The applicable manufacturer's written warranty; and

  • The NC Discount Furniture Warranty & Service Policy.

Unless NC Discount Furniture expressly provides a separate written warranty, NC Discount Furniture's assistance with a manufacturer's warranty does not expand the manufacturer's stated warranty.

Nothing in these Terms is intended to waive or restrict any warranty or consumer remedy that cannot lawfully be waived.

29. PRODUCT DESCRIPTIONS & WARRANTIES

Statements of fact, descriptions, samples, models, and written warranties may carry legal significance under applicable law.

For that reason, these Terms should not be interpreted as eliminating any express or implied warranty that cannot lawfully be excluded or modified.

NC Discount Furniture does not intend general website disclaimers to override rights created by applicable law.

30. TITLE & RISK OF LOSS

Ownership, title, responsibility for merchandise, and risk of loss are determined by the applicable sales contract, delivery terms, and governing law.

Nothing in these Terms is intended to transfer risk of loss to a customer earlier than applicable law permits.

Shipping damage occurring before or during an NC Discount Furniture-arranged delivery should be reported in accordance with our Damaged & Defective Merchandise Policy.

31. CUSTOMER ACCOUNTS

Certain website features may permit or require an account.

Customers are responsible for:

  • Maintaining accurate account information;

  • Protecting passwords;

  • Restricting unauthorized account access;

  • Promptly notifying us of suspected unauthorized use.

You are responsible for activity conducted through your account to the extent permitted by law.

NC Discount Furniture may suspend or terminate accounts used fraudulently, unlawfully, or in violation of these Terms.

32. CUSTOMER REVIEWS, PHOTOS & OTHER SUBMISSIONS

If you voluntarily submit:

  • Testimonials

  • Photographs

  • Videos

  • Questions

  • Comments

  • Design images

  • Other content

you represent that you have the right to submit that content.

You may not submit content that is:

  • False or materially misleading

  • Fraudulent

  • Defamatory

  • Threatening

  • Harassing

  • Obscene

  • Unlawful

  • Infringing

  • Malicious

  • Intended to impersonate another person

NC Discount Furniture may moderate, decline, or remove content where permitted by law and applicable platform policies.

Submitting a review does not require the customer to express a positive opinion.

NC Discount Furniture does not condition warranty assistance or legitimate customer service on the removal of truthful negative reviews.

33. LICENSE FOR CUSTOMER-SUBMITTED CONTENT

When you voluntarily submit content for publication on NC Discount Furniture's website or social-media channels, you grant NC Discount Furniture a non-exclusive, royalty-free license to use, reproduce, display, and distribute that content for legitimate business and marketing purposes, subject to applicable privacy and publicity rights.

This license does not transfer ownership of your original content.

You may contact us if you have questions concerning future use of customer-submitted content.

34. INTELLECTUAL PROPERTY

The NC Discount Furniture website and its original content may contain:

remain the property of their respective owners where applicable.

Use of the website does not transfer intellectual-property ownership to the user.

A chargeback does not automatically:

  • Cancel an order;

  • Create a return right;

  • Eliminate customer payment obligations;

  • Replace applicable damage or warranty procedures.

When responding to a payment dispute, NC Discount Furniture may provide relevant records to the applicable financial institution or payment processor, including:

  • Customer communications

  • Product information

  • Policy acknowledgments

  • Vendor records

  • Tracking

  • Return authorizations

Nothing in this section restricts any lawful right a consumer has to dispute a charge.

48. GOVERNING LAW

To the extent permitted by applicable law, these Terms and transactions with NC Discount Furniture will be governed by the laws of the State of North Carolina and applicable federal law, without regard to principles that would require application of another jurisdiction's law.

This provision does not deprive a consumer of non-waivable protections provided by the law applicable to that consumer.

49. DISPUTE RESOLUTION & VENUE

Before filing litigation, the parties are encouraged to make a good-faith effort to resolve disputes through direct communication.

To the extent permitted by applicable law, any court proceeding concerning these Terms or a transaction with NC Discount Furniture that is not required to proceed elsewhere will be brought in an appropriate state or federal court located in North Carolina.

Nothing in these Terms prevents a party from bringing an eligible claim in small claims court or exercising another legal right that cannot lawfully be restricted.

These Terms do not currently require mandatory private arbitration.

50. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed where necessary.

The remaining provisions will continue in effect.

51. NO WAIVER

Failure by NC Discount Furniture to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision later.

52. ASSIGNMENT

Customers may not assign their rights or obligations under these Terms without written consent where consent is legally permitted to be required.

NC Discount Furniture may assign its rights or obligations in connection with:

  • A merger

  • Reorganization

  • Sale of the business

  • Transfer of assets

  • Another lawful business transaction

subject to applicable law.

53. THIRD-PARTY BENEFICIARIES

Except where expressly stated otherwise, these Terms are intended for the benefit of the customer and NC Discount Furniture and do not create contractual rights for unrelated third parties.

This provision does not affect rights that manufacturers, payment providers, carriers, or other parties may have under separate agreements or applicable law.

54. CHANGES TO THESE TERMS

NC Discount Furniture may update these Terms from time to time.

The updated version will identify the date of the most recent revision.

Changes generally apply prospectively after posting.

Material changes will not retroactively eliminate rights that already accrued under a completed transaction where doing so would be prohibited by law.

The terms applicable to a particular order may include the policies and disclosures in effect when that order was placed, subject to applicable law.

55. ENTIRE AGREEMENT

These Terms, together with applicable:

  • Order confirmations

  • Quotes

  • Product-specific disclosures

  • Policies incorporated by reference

  • Written amendments agreed to by NC Discount Furniture

constitute the agreement governing the applicable transaction.

A customer-service conversation does not modify these Terms unless NC Discount Furniture expressly confirms the modification in writing.

56. LEGALLY REQUIRED RIGHTS

Nothing in these Terms is intended to waive, disclaim, limit, or eliminate any:

  • Consumer protection

  • Warranty

  • Refund right

  • Cancellation right

  • Product-liability right

  • Statutory remedy

  • Other right

that cannot lawfully be waived, disclaimed, limited, or eliminated.

If applicable law conflicts with a provision of these Terms, applicable law controls to the extent of the conflict.
