Damaged and Defective Merchandise Policy
DAMAGED & DEFECTIVE MERCHANDISE POLICY
At NC Discount Furniture, we want your furniture to arrive in good condition and meet the quality standards represented by the manufacturer. Because furniture is large, heavy, and often transported through multiple facilities before reaching its final destination, occasional shipping damage or manufacturing issues may occur.
This policy explains how NC Discount Furniture handles merchandise that arrives damaged, contains missing or incorrect components, or is believed to have a manufacturing defect.
Damage or a defect does not automatically qualify an order for return or refund. NC Discount Furniture will evaluate each claim and determine the appropriate resolution based on the nature of the issue, available manufacturer remedies, product availability, and applicable law.
1. INSPECT YOUR FURNITURE AT DELIVERY
Customers should carefully inspect their merchandise at the time of delivery whenever reasonably possible.
Before the delivery team leaves, please:

Inspect the exterior packaging for holes, tears, crushing, punctures, water damage, or other visible damage.

Inspect the merchandise for visible damage.

Confirm that the correct merchandise and quantity have been delivered.

Photograph any visible damage.

Photograph damaged packaging.

Note visible damage or missing merchandise on the carrier's delivery receipt before signing whenever possible.

Keep a copy or photograph of the delivery receipt.
Do not sign a delivery receipt indicating that merchandise was received in good condition if significant visible damage is present.
Signing a delivery receipt does not necessarily eliminate all rights relating to concealed damage, but documenting visible damage at delivery can be important when NC Discount Furniture submits a claim to the carrier or manufacturer.
2. REPORTING SHIPPING DAMAGE
Please report shipping damage to NC Discount Furniture within 48 hours of delivery whenever reasonably possible.
Prompt reporting is important because manufacturers and freight carriers may impose short deadlines for transportation damage claims.
A delayed report may affect our ability to recover from the freight carrier or manufacturer and may limit available remedies. However, nothing in this policy is intended to eliminate rights or remedies that cannot legally be waived.

3. DOCUMENTATION REQUIRED FOR A DAMAGE CLAIM
To evaluate and process a claim, we may request:

Customer name

Delivery date

Description of the problem

Photograph of the entire item

Close-up photographs of each damaged area

Photographs of the exterior packaging

Photographs of the interior packaging

Video demonstrating the issue, if appropriate
Please do not discard packaging until NC Discount Furniture confirms that it is no longer needed for the claim.
Failure to provide reasonably requested photographs or documentation may delay our ability to evaluate or process the claim.
4. CONCEALED SHIPPING DAMAGE
Some transportation damage may not be visible until merchandise is unpacked.
If concealed damage is discovered:

Stop unpacking if doing so could cause additional damage.

Photograph the merchandise and packaging immediately.

Retain all packaging materials.

Contact NC Discount Furniture as soon as possible.
Please do not assemble, alter, repair, dispose of, or continue using significantly damaged merchandise until we have reviewed the claim, unless doing so is necessary for safety.
5. SEVERELY DAMAGED MERCHANDISE AT DELIVERY
If an item has significant visible damage that makes it unusable, unsafe, or substantially different from the condition in which it should have arrived, photograph the damage and contact NC Discount Furniture as soon as possible.
Depending on the circumstances and the delivery carrier's procedures, the customer may be instructed to refuse the affected item.
Do not refuse an entire delivery solely because one component has minor or repairable damage unless instructed to do so by NC Discount Furniture or the delivery provider.
An unauthorized refusal of merchandise that is not materially damaged may be treated as a refused delivery rather than an approved damage claim and may result in additional freight, storage, handling, or redelivery charges.
6. MINOR OR REPAIRABLE SHIPPING DAMAGE
Furniture does not necessarily require full replacement because of minor or localized transportation damage.
Examples may include:

Minor dents

Hardware damage

Damaged legs or feet

Broken handles or pulls

Minor upholstery damage

Damaged removable components
When appropriate, NC Discount Furniture may resolve these issues through:

Professional furniture repair

Manufacturer-authorized service

Another reasonable corrective remedy
A refund will not ordinarily be issued when the merchandise can reasonably be restored to its intended condition through repair or replacement of a component.
7. MANUFACTURING DEFECTS
A manufacturing defect is an issue arising from the construction, materials, workmanship, or manufacturing of the product rather than transportation damage, normal product variation, normal wear, or customer-caused damage.
Examples may include:

Structural manufacturing failures

Defective mechanisms

Improperly manufactured components

Missing factory-installed components

Manufacturing-related upholstery defects

Manufacturing-related hardware problems

Other conditions that prevent the product from functioning as reasonably intended
If you believe your merchandise has a manufacturing defect, notify NC Discount Furniture promptly after discovering the issue.
We may request photographs, videos, measurements, serial numbers, product labels, or additional information so that the issue can be reviewed by NC Discount Furniture and, where appropriate, the manufacturer.
8. MANUFACTURER WARRANTY CLAIMS
Some products sold by NC Discount Furniture are covered by a manufacturer's written warranty.
Warranty coverage, duration, limitations, exclusions, and available remedies vary by manufacturer and product.
When an applicable manufacturer warranty exists, NC Discount Furniture may assist the customer in submitting information to the manufacturer and coordinating the manufacturer's approved remedy.
Depending on the warranty and the circumstances, that remedy may include:

Replacement parts

Repair
-
Technician service
-
Replacement components
-
Replacement merchandise
-
Another remedy provided under the applicable warranty
Manufacturer warranty coverage does not necessarily mean that a customer is entitled to a refund.
Copies of applicable written manufacturer warranty information may be requested from NC Discount Furniture when available.
9. OUR RIGHT TO REPAIR OR REPLACE
For a verified damage or defect claim, NC Discount Furniture will determine an appropriate resolution based on the specific circumstances and applicable legal requirements.
Where reasonable, NC Discount Furniture may first offer:

Replacement parts or components;

Professional repair;
-
Manufacturer warranty service;
-
Replacement of the affected item; or
-
Another reasonable remedy.
The customer may not require a refund simply because they prefer a refund over an available repair, part replacement, or merchandise replacement, except where a refund is required by applicable law.
NC Discount Furniture will determine whether repair or replacement is reasonably appropriate based on factors including:

Nature and severity of the issue

Whether the product remains structurally sound

Availability of replacement components

Availability of replacement merchandise

Manufacturer recommendations

Repair feasibility

Applicable warranties

10. WHEN A REFUND MAY BE CONSIDERED
Although NC Discount Furniture maintains an All Sales Final policy, a refund may be considered when:

NC Discount Furniture confirms that an item cannot reasonably be repaired;

A suitable replacement is unavailable;
-
The manufacturer is unable to provide an appropriate remedy;

NC Discount Furniture determines that a refund is the most appropriate resolution; or
-
A refund is required by applicable law.
Any approved refund will generally be issued to the original payment method unless otherwise agreed or required.
11. REPLACEMENT MERCHANDISE
When replacement merchandise is approved:

Replacement availability is subject to manufacturer inventory.

Replacement lead times may differ from the original delivery estimate.

The customer may be required to retain the damaged merchandise and packaging until further instructions are provided.

NC Discount Furniture or the manufacturer may arrange retrieval of the affected merchandise.

The customer must make the affected merchandise reasonably available for authorized pickup when required.
Customers should not dispose of damaged merchandise unless NC Discount Furniture provides written authorization to do so.
12. MISSING PARTS OR COMPONENTS
If merchandise arrives with missing:

Handles

Power supplies

Assembly components

Other included parts

Missing components generally will be resolved by obtaining the appropriate replacement component rather than replacing or refunding the entire item.
13. INCORRECT MERCHANDISE
If you receive merchandise that is materially different from what is listed on your NC Discount Furniture order confirmation, contact us promptly.
Please do not assemble, modify, install, use, or discard the packaging for incorrectly delivered merchandise unless instructed by NC Discount Furniture.
After confirming the error, NC Discount Furniture will coordinate an appropriate correction at no additional merchandise cost to the customer.
14. NATURAL MATERIAL VARIATIONS ARE NOT DEFECTS
Many of the products sold by NC Discount Furniture contain natural materials or handcrafted finishes.
Natural and acceptable variations may include differences in:

These characteristics may vary from one item to another and from showroom samples, swatches, photographs, or website images.
Reasonable natural or manufacturing variations are not considered damage or defects.
15. COLOR AND FINISH VARIATIONS
The color of furniture displayed online may vary from the actual product because of:

Screen brightness

Fabric dye lots

Wood grain

Stain absorption

Natural materials

Manufacturer production variations
Reasonable differences in color, grain, pattern, texture, sheen, or finish do not constitute damage or a manufacturing defect.
Customers purchasing finish-sensitive merchandise are encouraged to request available material, fabric, leather, or finish samples before placing an order.
16. NORMAL CHARACTERISTICS OF UPHOLSTERED FURNITURE
The following may occur with upholstered furniture and are not necessarily manufacturing defects:

Minor puckering

Feather migration

Softening with use

Slight differences in cushion firmness

Whether a condition constitutes a defect will depend on the product, manufacturer specifications, and severity of the condition.
17. CUSTOMER-CAUSED DAMAGE IS NOT COVERED
Damage caused after delivery is not considered shipping damage or a manufacturing defect.
Examples include damage caused by:

Failure to follow manufacturer instructions

Unauthorized repairs

Modifications

Moving or relocating the furniture

Dropping or striking the merchandise

Pets

Children

Spills or stains

Direct sunlight

Normal wear and tear

Commercial use of merchandise intended for residential use
Such damage is not eligible for remedy under this Damaged & Defective Merchandise Policy unless otherwise covered by an applicable manufacturer warranty.
18. DAMAGE OCCURRING AFTER DELIVERY
Once merchandise has been delivered in acceptable condition, damage caused while moving, assembling, installing, storing, or using the merchandise generally becomes the responsibility of the customer.
If NC Discount Furniture has arranged an authorized delivery or assembly service and the customer believes damage occurred during that service, the customer should notify NC Discount Furniture promptly so the matter can be investigated.
19. DO NOT ATTEMPT UNAUTHORIZED REPAIRS
Customers should not attempt substantial repairs, alterations, refinishing, reupholstery, structural modifications, or other corrective work before NC Discount Furniture or the applicable manufacturer has evaluated the claim.
Unauthorized repairs or modifications may:

Make it difficult to determine the original cause of the problem;
-
Cause additional damage;
-
Affect carrier claims; or
-
Affect applicable manufacturer warranty coverage.
If immediate action is necessary to prevent injury or additional property damage, take reasonable safety precautions and contact NC Discount Furniture as soon as possible.
20. SAFETY-RELATED DEFECTS
If you believe an item presents an immediate safety hazard:
Stop using the product immediately.
Keep children and others away from the merchandise when appropriate and contact NC Discount Furniture promptly.
Do not continue using furniture that appears structurally unstable, electrically unsafe, or otherwise likely to cause injury.
21. CLAIM REVIEW PROCESS
After receiving a complete claim, NC Discount Furniture may:

Review the submitted photographs and documentation;

Request additional information;
-
Contact the freight carrier;
-
Contact the manufacturer;
-
Request inspection by a technician or furniture repair professional;
-
Determine whether the condition is transportation damage, a manufacturing defect, normal product variation, or customer-caused damage; and
-
Determine the appropriate available resolution.
Submitting a claim does not mean that the claim has automatically been approved.
NC Discount Furniture will communicate the claim determination and next steps to the customer after sufficient information has been received and reviewed.
22. CUSTOMER COOPERATION
Customers are expected to reasonably cooperate with the claim process.
This may include:

Providing requested photographs

Providing videos
-
Retaining merchandise
-
Retaining packaging
-
Providing serial or model numbers
-
Allowing an authorized inspection
-
Allowing a qualified repair technician to inspect or repair the item
-
Making merchandise available for authorized pickup
-
Returning damaged components when requested
Failure to reasonably cooperate may prevent NC Discount Furniture, the carrier, or the manufacturer from completing the claim process and may affect the remedies available.
23. DELIVERY AND CLAIM FRAUD
NC Discount Furniture reserves the right to investigate claims that contain conflicting information, altered photographs, evidence of post-delivery damage, or other indications that the claimed damage or defect may not have occurred as reported.
Submitting false information in connection with a damage, defect, warranty, payment, or delivery claim may result in denial of the claim and other remedies available to NC Discount Furniture.
24. RELATIONSHIP TO OUR ALL SALES FINAL POLICY
This Damaged & Defective Merchandise Policy should be read together with the NC Discount Furniture All Sales Final: Return, Cancellation & Refund Policy.
Our All Sales Final policy does not prevent customers from reporting legitimate shipping damage, manufacturing defects, incorrect merchandise, or other issues for which a remedy is required under this policy or applicable law.
At the same time, reporting damage or a defect does not convert an otherwise final-sale purchase into a returnable purchase.
25. LEGALLY REQUIRED RIGHTS
Nothing in this policy is intended to disclaim, restrict, or waive any warranty, remedy, consumer protection, or other legal right that cannot lawfully be disclaimed, restricted, or waived.
If applicable law requires a remedy different from or greater than the remedies described in this policy, NC Discount Furniture will comply with applicable law.
